Privacy policy

This Personal Data Privacy Policy (the “Privacy Policy”) has been developed in accordance with the Constitution of the Russian Federation, Federal Law No. 149-FZ of July 27, 2006 “On Information, Information Technologies and Information Protection”, Federal Law No. 152-FZ of July 27, 2006 “On Personal Data” (the “Personal Data Law”) and other regulations on the protection and processing of personal data in force in the Russian Federation, and applies to the site located at https://arcania.fun (the “Site”).

Using the Site's services means the User's unconditional consent to this Policy and the terms of processing of their personal information set out in it; if the User disagrees with these terms, they must refrain from using the services.

Site means the interactive set of pages located at the domain name https://arcania.fun/.

Site User means an individual using the Site's services, a personal data subject who has voluntarily registered on the Site and provided the necessary personal data at registration.

Personal data means any information relating to a directly or indirectly identified or identifiable individual (personal data subject).

Personal data processing means any action (operation) or set of actions (operations) performed with or without automation on personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, changing), extraction, use, transfer (distribution, provision, access), anonymization, blocking, deletion and destruction of personal data.

1.1.Within this Policy, the User's personal information means:

1.1.1.Personal information the User provides about themselves while using the services, including the User's personal data. Information required to provide the services is marked in a special way.

1.1.2.Data automatically transferred to the Site's services during their use by software installed on the User's device, including IP address, cookie data, information about the User's browser (or other program used to access the services), technical characteristics of the hardware and software used by the User, date and time of access to the services, addresses of requested pages and other similar information.

1.1.3.This Privacy Policy applies only to the Site https://arcania.fun/. The Site https://arcania.fun/ does not control and is not responsible for third-party sites the User may reach through links available on the Site.

2.1.The Site collects and stores only the personal information needed to provide the services or perform agreements and contracts with the User, except where the law requires personal information to be kept for a set period. On receiving notice from the User withdrawing consent to personal data processing, the Site stops processing the User's personal data within no more than 10 working days of receipt. Notice of withdrawal of consent is sent to the email address: support@arcania.fun.

2.2.The Site processes the User's personal information for the following purposes:

2.2.1.Identifying a User registered on the Site.

2.2.2.Concluding, performing and terminating civil law contracts with individuals, legal entities, sole proprietors and other persons in the cases provided by the legislation of the Russian Federation and the Site's Charter.

2.2.3.Processing personal data on behalf of personal data operator(s) when concluding personal data processing contracts with an operator, including with cross-border data transfer to foreign states that are parties to the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data (Strasbourg, January 28, 1981), ensuring adequate protection of the rights of personal data subjects.

2.2.4.Statistical or other research purposes, except for promoting goods, works and services on the market and except for political campaigning, provided the personal data is anonymized.

2.2.5.Concluding, performing and terminating contracts resulting in ownership (or the right to acquire such rights in the future), the right to register ownership or another legal right to real estate under the legislation of the Russian Federation, and providing services to individuals, legal entities, sole proprietors and other persons in the cases provided by the legislation of the Russian Federation and the Site's activities.

2.2.6.Any contact with the User through the channels they have given, including for analytics of an individual's actions on the website, processing incoming requests, sending information about the Site's products and services, performing contracts (to which the personal data subject is or will be a party), exchanging information between the Site and the Site's Partners, and sending advertising and informational mailings about any marketing and advertising campaigns.

2.2.7.Establishing feedback with the User, including sending notifications and requests about the use of the Site and the provision of services, and processing requests and applications from the User.

2.2.8.Carrying out advertising activities with the User's consent.

3.1.The Site stores Users' personal information in accordance with the internal rules of specific services.

3.2.The User's personal information remains confidential, except where the User voluntarily makes information about themselves publicly available to an unlimited number of persons. When using certain services, the User agrees that a certain part of their personal information becomes public.

3.3.The Site may transfer the User's personal information to third parties in the following cases:

3.3.1.The User has consented to such actions.

3.3.2.The transfer is necessary for the User to use a certain service or to perform a certain agreement or contract with the User.

3.3.3.The transfer is provided for by Russian or other applicable law within the procedure established by law.

3.4.The User's personal data is processed without time limit in the following ways: collection, recording, systematization, accumulation, storage, clarification (updating, changing), extraction, use, transfer (distribution, provision, access), anonymization, blocking, deletion and destruction of personal data, including in personal data information systems with or without automation. Users' personal data is processed in accordance with Federal Law No. 152-FZ of July 27, 2006 “On Personal Data”.

3.5.In the event of loss or disclosure of personal data, the Site informs the User of it.

3.6.The Site takes the necessary organizational and technical measures to protect the User's personal information from unlawful or accidental access, destruction, alteration, blocking, copying and distribution, and from other unlawful actions of third parties.

3.7.The Site, together with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User's personal data.

4.1.The User must:

4.1.1.Provide the personal data information needed to use the Site.

4.1.2.Update and supplement the personal data information provided if it changes.

4.2.The Site must:

4.2.1.Use the information received only for the purposes stated in this Privacy Policy.

4.2.2.Keep confidential information secret, not disclose it without the User's prior written permission, and not sell, exchange, publish or otherwise disclose the User's personal data, except as provided by this Privacy Policy.

4.2.3.To protect the User's personal data during processing, the following legal, organizational and technical measures have been taken against unauthorized, unlawful or accidental access to personal data, its destruction, alteration, blocking, copying, provision and distribution, and against other unlawful actions with personal data.

4.2.4.Block personal data relating to the User concerned from the moment of a request by the User, their legal representative or the authorized body for the protection of personal data subjects' rights, for the period of verification if inaccurate personal data or unlawful actions are found.

5.1.A Site that has not fulfilled its obligations is liable for losses incurred by the User due to the unlawful use of personal data, in accordance with the legislation of the Russian Federation.

5.2.In the event of loss or disclosure of confidential information, the Site is not liable if this information:

5.2.1.Became public before its loss or disclosure.

5.2.2.Was received from a third party before the Site Administration received it.

5.2.3.Was disclosed with the User's consent.

6.1.Before going to court over disputes arising from relations between the Site User and the Site, a claim (a written proposal to settle the dispute voluntarily) must be filed.

6.2.Within 10 calendar days of receiving the claim, its recipient notifies the claimant in writing of the results of its review.

6.3.If no agreement is reached, the dispute is referred to court in accordance with the current legislation of the Russian Federation.

6.4.The current legislation of the Russian Federation applies to this Privacy Policy and to relations between the User and the Site Administration.

7.1.The Site may change this Privacy Policy without the User's consent.

7.2.The new Privacy Policy takes effect when posted on the Site, unless the new version provides otherwise.
